Marriage certificates turn up in German Standesamt filings, spousal visas, and nationality determination files. It is a state document and never goes to the Department of State.

Your marriage certificate goes to the state that issued it, not to Washington

A marriage certificate is a state document, so it is apostilled by the Secretary of State of the state that issued it. Not the U.S. Department of State, and not the state you live in now. If you married in Ohio and live in Virginia, it goes to Ohio. Sending a state record to the Department of State gets it returned unprocessed, and it is the most frequent mistake we see on Germany files.

Your FBI background check is the opposite: it is a federal document that only the U.S. Department of State can apostille. Most Germany applications need both, and we route each one correctly in a single order.

Germany leaves the translation decision to the receiving authority, and that cuts both ways

Germany is genuinely discretionary, so be careful with anyone who tells you otherwise. The Auswärtiges Amt states that translations by a translator publicly sworn or recognized in Germany are routinely accepted, and that whether a translation produced abroad can be used is decided by the individual authority at its own discretion. The competent Standesamt decides the form your file takes, including whether a translation or apostille is needed at all.

The German standard is a beeidigter, vereidigter or ermächtigter Übersetzer sworn before a German court, searchable in the public directory at justiz-dolmetscher.de.

One hard line worth knowing: for a federal nationality file at the Bundesverwaltungsamt, an unsworn translation is refused outright. Their guidance is unambiguous. If that is your use case, do not risk a US translation.

Order of operations

Apostille first, then translate. The Auswärtiges Amt also notes the apostille procedure does not apply to translations themselves, since a translation is an expert service rather than a public document.

Worth knowing

German missions in the US do not endorse individual American translators. Their official list contains only associations plus the German court directories, and notes the US has no sworn-translator equivalent.
