What Is an Apostille and Why Can Only the Department of State Issue One for FBI Background Checks?

If you are new to apostilles, you are not alone. Most fingerprinting companies have never had to think about this step. Here is what you need to know.

What an Apostille Is

An apostille is a certificate that authenticates a document for international use. It exists because of the Hague Apostille Convention, a treaty signed by 126 countries. When someone needs to use a U.S. document in any of those 126 countries, the receiving government requires an apostille to verify the document is legitimate. Without it, the document is not legally recognized abroad.

Why a Notary Cannot Do This

A notary can notarize certain documents and, in some cases, take state-level documents to a Secretary of State for authentication. But an FBI background check is a federal document issued by a federal agency. Federal documents can only be apostilled by the U.S. Department of State. No state office, no notary, no local authority has the power to apostille an FBI background check. This is why so many notary businesses send their clients' FBI checks to us.
